TERMS & CONDITIONS OF SALE 1.Orders All goods and services are subject to availability. If the goods you have ordered are unavailable, you will be notified within 2 working days and will be given an opportunity to purchase a suitable alternative or receive a full refund. Purchasers must be over the age of 18 years. Where a person under the age of 18 attempts to buy goods, the contract will be null and void. Payment in full must be received before your order can be processed. When processing your order, the information provided will be subject to credit and fraud prevention checks. For these purposes we may transfer your information to third parties. While all reasonable care is taken to protect the confidentiality of your credit card details, Garden Machinery Gloucester cannot be liable if, through no fault of its own, these details are intercepted by and used by third parties. 2.Cancellation Provided you keep the goods in ‘as new’ condition, you are entitled to withdraw from this contract without stating any cause within 7 days of delivery. You must communicate such withdrawal to us within that 7-day period. Goods must be returned within 14 days of the delivery date to our contact address at your own cost and risk. Garden Machinery Gloucester reserves the right to reimbursement of the costs of delivery where goods are returned for no cause, as set out above. 3.Pricing Charges for delivery are not included in the stated product price – see the Delivery section for details of applicable charges. Whilst Garden Machinery Gloucester will try to ensure that prices on the website are accurate, we are not responsible for errors that may occur. If we discover any errors in the price of goods before we accept your order, we will notify you as soon as possible and give you the option to resubmit your order at the correct price or cancel the order. The price of all goods and services advertised are inclusive of any applicable taxes including VAT. 4.Payment We offer a secure means of ordering and paying for your products via this site. Alternatively, you can order and pay by telephone on 01452 523918. We must receive payment of the whole of the price for the goods you order before your order can be accepted. Our acceptance of your order will bring into existence a legally binding contract us. Acceptance will occur on either the debiting of your credit card or the clearance of your cheque. A contract will not affect your statutory rights. 5.Delivery Delivery can only be made to addresses in the UK mainland. In most cases products will be dispatched to your preferred address directly from our distributors following a PDI check, which is needed to validate the manufacturer’s warranty. Goods ordered on this website cannot be collected from our store. A detailed receipt, together with a copy of the credit card payment receipt, will be posted separately to you on the same day. Where orders are placed before 3pm, goods will normally be delivered the next working day, although this cannot be guaranteed. Delivery of ride on tractor mowers is usually 7-10 working days after receipt of the order. 6.Faulty Goods If the goods are faulty or different from those ordered, you will need to contact us so that we can provide you with return instructions. Unused goods must be returned within 14 days of the delivery date at your own cost and risk. We will refund your costs provided that the goods are received by us in the condition they were in when delivered to you. The information that we collect about you lawfully (in accordance with the Data Protection Act 1998) will be used only for the purpose of fulfilling orders and answering enquiries. Consumers’ personal details are handled with total confidentiality and will never be passed to third parties. English Law applies. |
